1. Purchase of Tickets & Payment

1. All selling of Tickets on the Platform are on “first come first serve” and on “as is” basis. We may make reasonable efforts to furnish the details of Transportation Carriers including but not limited to the type of coach provided, seating plan and/or on board facilities (“transportation details”) to you. However, we shall not be held liable and responsible should any details of the Transportation Carrier is inaccurate or not up to date as a result of change of transportation details by the Transportation Carriers.

2. All prices shown at the payment info section on the Platform constitute the final purchase price of the Tickets. The breakdown of the prices includes but not limited to (i) the base fare to the destination, (ii) the terminal charges, (iii) insurance charges, (iv) applicable taxes, and/or (iv) any applicable admin fee and charges, payment gateway surcharges and/or services fee and charges.

3. You must pay the full prices by using various payment methods made available by us. Such payment methods shall not limit to Credit Cards, Debit Cards, Online Banking and such other methods as notified by us from time to time.

2. Confirmation of Booking

1. Upon successful payment has been made, an order summary (may include an e-ticket) of the Ticket purchased will be forwarded to your designated email address that you furnished with us during the booking and/or at the point of payment. It is vital and necessary that the email address is valid, accurate and in the correct and unabbreviated form.

2. Unless otherwise made available by us, all order summary and/or e-ticket delivered shall ONLY in digital form. You may require to print out the order summary and redeem the same at the Transportation Carrier’s counter at the terminal and/or at such designated counter as notified by the Transportation Carrier prior to your departure.

3. PLEASE TAKE NOTE THAT THE PURCHASE OF TICKETS IS SUBJECT TO THE ISSUANCE OF THE TICKETS BY TRANSPORTATION CARRIER IN ACCORDANCE WITH YOUR PURCHASE. AS SUCH, YOU MAY NOT RECEIVE YOUR TICKET AND/OR BOOKING CONFIRMATION IMMEDIATELY UPON PAYMENT. WE SHALL NOT BE HELD RESPONSIBLE FOR ANY FAILURE TO ISSUE TICKETS BY THE TRANSPORTATION CARRIER. WE APOLOGISE FOR THE INCONVENIENCE, AND A FULL REFUND WILL BE GIVEN SHOULD THE BOOKING FAIL.

3. Delay, Reschedule and Cancellation by the Transportation Carriers

1.In any circumstances if we have been notified by a Transportation Carrier that a schedule has been amended, changed, cancelled and/or revised for any reason whatsoever (“changes”), we shall as soon as possible to notify you on the changes and, if applicable, to provide reasonable alternative options to you. Nevertheless, you agree to not hold us responsible and liable for any in the event of the changes happened.

2.You are advised to arrive at the terminal, checkpoint and/or at such waiting area as notified by us or the Transportation Carrier from time to time at least thirty (30) minutes or at such arrival time as advised by the Transportation Carrier from time to time before the scheduled departure time. You are to ensure that all requirements for a smooth departure has been duly completed including but not limited to identity verification, custom clearance, bagging check in and etc.

4. Requests for Change, Reschedule and/or Refund

1. All requests for change, reschedule and/or refund (fully refund or partially refund) of the purchased Ticket by you is subject to the applicable regulation and approval from the Transportation Carrier, with a certain amount of charges applied. All decisions made by the Transportation Carrier on any request of change, reschedule and/or refund are final and exclusive. By default, all Tickets purchased are non-refundable, non-transferable, non-exchangeable and no cancellation.

2. In event if we have been requested by you to assist with your request of change, reschedule and/or refund of the Tickets, we will, at our sole discretion, charge you an amount of the fee being the handling fee of your request. Such handling fee may be informed by us from time to time.

5. Usage of Ticket

1. All Tickets are subject to its own terms and conditions including but not limited to baggage allowances as imposed by the Transportation Carriers from time to time. You are advised to read the terms and conditions upon purchase of the Tickets and/or to seek clarification from the Transportation Carrier. We shall not be responsible nor liable for any which arises in relation to the use of the Tickets by you as stated herein.

2. We advise you reconfirm all Transportation Carriers seventy-two (72) hours prior to departure directly with the Transportation Carrier or simply check-in online at the applicable Transportation Carrier’s website. You must check and verify the latest schedule no later than one (1) day before departure, as the scheduled departure and/or arrival times may change significantly without prior notice. You are solely responsible for checking-in on time, regardless of schedule changes, if any.

6. Passenger Notification

1. Passenger information, including but not limited to passenger’s first name, last name, passport/ID number, contact information must be authentic and the same between the official document and the online form passenger filled in on the Platform while purchasing the Ticket. Transportation Carrier has the right to reject issuing any ticket, boarding pass or reject boarding if the names submitted via the online booking form and the names printed on the passenger’s ID/passport are different. Terminal Meru Raya is not liable or responsible for any losses or costs incurred for the above-mentioned situation.

7. Liabilities

1. Under no circumstances will we be liable to you in relation to the Tickets including its price, transportation details, seats description, baggage description, time, availability and etc. that show on our Platform.

2. Pursuant to Clause 2.1 above, we are not liable for any email delivery failure or non-delivery of order summary (and/or e-ticket) of the Ticket purchased which shall cause by you inter alia entering an incorrect email address or incorrect email settings.

3. Terminal Meru Raya nor any of its employees, warrant that the functions contained in this website will be uninterrupted or error-free. The entire risk as to the quality and performance of this website is with you. In no event will Terminal Meru Raya be liable to you for any damage, including, but not limited to, service interruptions, or any other circumstances beyond our reasonable control, any lost profits, lost savings or other incidental, consequential, punitive, or special damages arising out of the operation of or inability to operate this website.

4. Unless otherwise agreed by the Transportation Carrier on the request of refund of Tickets, Terminal Meru Raya shall not be liable for the refund of the Tickets to you. In the event the Transportation Carrier has agreed to refund the Ticket price to you, you are prohibited from claiming the same refund from us.

5. We shall not be held liable and responsible for any sanctions, penalties and fines as a result of the Passenger's failure to comply with the applicable laws and regulations.

8. Limitation of Liability

1.Without prejudice to what is set out in these terms, our liability is limited and excluded to the maximum extent permitted by law, such as for personal injury and death. We shall not be liable for any losses or damages, whether direct or indirect, resulting from or connected to your purchase and use of the Tickets, use of our Platform or use of the links on the site, including but not limited to special, incidental, punitive or consequential damages or other economic loss, even if we have been advised of the possibility of loss or damage that may occur. The only available remedy for you is termination of use of our Platform.

9. General

1. The terms herein stated shall constitute the entire agreement and understanding between you and us on the subject matter thereof, and shall supersede all prior agreements, whether written or oral, between you and us concerning the subject matter thereof.

2. The terms herein stated shall be governed by and interpreted in accordance with the Laws of Malaysia.

3. Privacy. You have read and understand our Privacy Policy as stated on our website. By voluntarily submitting your personal data including but not limited to your name and contact details to us, you hereby consent and accept the terms of the Privacy Policy.

4. We reserve all our rights in corporate names, service marks, logos, trade names, trademarks, websites and domain names and any other intellectual property in relation to Terminal Meru Raya or otherwise (collectively "Marks") and nothing herein grants you a license to use such Marks.

Introduction

This privacy policy (“Privacy Policy”) described how Easybook.com Pte.Ltd, its respective subsidiaries, affiliates, associated companies and jointly controlled entities (collectively, “subsidiaries”) (“Easybook”, “we”, “us” or “our”) collect, use, process, share and disclose information about you when you visit and interact on our website (mobile and desktop) and mobile app (collectively, “Site”) or other means connected to the Sites (such as contacting our customer service team via chat or email).

This Policy applies to our users, customers, passengers, agents, vendors, suppliers, partners (such as transport operators and merchant partners), contractors and service providers (collectively “you”, “your” or “yours”).

Personal Data” is any information which can be used to identify, directly or indirectly, you or from which you are identifiable. This includes but is not limited to your name, nationality, telephone number, bank and credit card details, personal interests, email address, your image, government-issued identification numbers, biometric data, race, date of birth, marital status, religion, health information, vehicle and insurance information.

  1. INFORMATION WE COLLECT

    We collect Personal Data about you in the ways listed below. We may also combine the collected Personal Data with other Personal Data in our possession: -

    • We collect information about you that you voluntarily provide to us when using the Site, such as your name, address, phone number, payment details, credit card details, and e-mail address.
    • By visiting our Site, we may also automatically collect certain usage information, such as your IP address, geographic data, country, search preferences related to specific searches, browser, and information about your device's operating system, application version, language settings, and pages that have been shown to you.     • We collect information if you need to get in touch with our customer support team or reach out to us through other means (such as through social media or communicating with our transport operators).
    • Where you submit reviews regarding your booking experiences, rides, trip experiences or other ancillary services available on our Site through us, we will collect information from you including your reviews, your name, you email address and/or country of residence.
    • Where you are making a reservation and/or booking with other guests or passengers whose details you provide to us as part of your reservation and/or booking, or if you make a reservation and/or booking on behalf of someone else, it is your responsibility to ensure that the person or people you have provided Personal Data about are aware that you have done so, and have understood and accepted how Easybook uses their information (as described in this Privacy Policy).
    • Our agents or partners may share information about you with us if you have questions about your reservation and/or booking or if disputes arise regarding your reservation and/or booking in relation to the services provided by us.
    • Unless otherwise necessary to comply with legal or regulations requirements, we may collect information that is sensitive in nature such as national ID numbers, race, marital status, and your health or religious beliefs.
  2. PURPOSES

    We may use, combine and process the Personal Data collected through the Site to:

    • Provide you with the requested products and/or services, such as creating a user account with us, processing and confirming your reservation and/or booking, responding and/or communicating with you about our services, your enquiries, special requests, cancellations, and/or rewards;
    • respond to questions, comments and feedback from you;
    • investigate and address concerns raised by you in relation to the products and/or services;
    • process the reservation and/or booking, payments related matters, business analytics;
    • Send you email marketing communications inter alia mobile push notifications, emails, SMS, MMS, and/or phone calls (telemarketing) about products and services that may be relevant to you. You may, however, at any time choose to opt out of these marketing communications from us pursuant to Section 11 below.
    • Conduct surveys, market researches and developments or provide you with information about our services on our Site or on other websites you may visit;
    • Maintain and improve the Site, tailor and enhance the user experience, and for internal training;
    • monitoring, processing and/or tracking your use of the Site in order to provide you with a seamless experience;

    • Exercising a right or obligation conferred or imposed by law, including responding to request and legal demands;

These suppliers may inter alia contact you as necessary to obtain additional information about you, facilitate your travel reservation, or respond to a review you may submit in accordance with their own independent privacy policies.
    • Business Partners with whom we may jointly offer products or services, or whose products or services may be offered on our Sites, or whose products or services which we think you may be interested in.
    • Where Required or Permitted by Law - such as to protect ourselves against liability, to respond to subpoenas, judicial processes, legitimate requests, warrants or equivalent by law enforcement officials or authorities, to investigate fraud or other wrongdoing or as otherwise required or necessary in order to comply with applicable law. We may also, in compliance with applicable law, disclose your information to enforce or apply the terms and conditions applicable to our services or to protect the rights, property, or safety of Easybook, our users, or others.
    • Business Reorganization - such as part of any sale, assignment or other transfer of our business, or transition of service to another provider. We will ask for your consent if required by applicable law.
  4. MINORS UNDER 18 YEARS OLD

    Our Site is not directed to minors under the age of 18. However, minors can normally accompany their parent(s) or legal custodian(s) who have reserved, booked, or purchased our products and/or services.

    Our Site uses and allows third parties to place cookies (session and persistent), pixels/tags, SDKs, application program interfaces ("APIs"), and other technologies (collectively, "Cookies") on our Site that collect and store certain information about you.     • Deletion: You may request that we delete your Personal Data or account.
    • Restrictions of Processing: You may ask us to cease processing of your Personal Data for example if you have objected to the processing and the existence of legitimate grounds is still under consideration.
    • Objection: You may object, at any time, to your Personal Data being processed by us for direct marketing purposes.
